PRIVACY POLICY

This Privacy Policy discloses the privacy practices for the Live Your Life Learning (http://liveyourlifelearning.com/) site (referred to as our or this “site”).  Live Your Life Learning, LLC, a Nebraska limited liability company (referred to as “us”, “we” or the “Company”), the provider of the site, is committed to protecting your privacy online.  Please read this Privacy Policy before using our site or providing personal information to us.

  1. General

This Privacy Policy is part of our Terms & Conditions of Site Use.  By accessing or using the site, you accept and agree to be bound by this Privacy Policy.  If you do not agree to this Privacy Policy, please do not access or use this site or share your personal information with us.  This Privacy Policy applies only to this site, and not to any other website linked to it. We do not control the privacy policies or practices of others. We encourage you to read and understand the privacy policies of other websites before you disclose any personal information to them.

This Privacy Policy explains (i) how we collect and use your information; (ii) how we share your information; (iii) how we protect your information; (iv) your choices regarding our use of such information; and (v) your ability to access and correct your information.

  1. Types of Information Collected

We collect two types of information about our users: personally identifiable information and non-personally identifiable information.

“Personally identifiable information” refers to information that personally identifies you, such as your name, postal address, e-mail address, other contact information or credit card information (or other information that is associated or aggregated by us with such above information).

“Non-personally identifiable information” refers to information that does not personally identify you, including anonymous information, and information regarding your use of this site.  Non-personally identifiable information is compiled and analyzed on both a personal and an aggregated basis.

  1. Collection and Use of Information

We collect personally identifiable information from you as follows:

A) If we offer and you participate in any public forums, such as comment sections of any webpage, message boards, chat rooms, and social community environments, we may request certain personally identifiable information from you, including your name and e-mail address. Any personal information you provide when using any of these features may be visible to other users.

B) You may choose to contact the Company, by e-mail or otherwise, with comments, questions, inquiries, feedback, or other information. Any personally identifiable information that is provided in connection with such inquiries will be collected, accessed and used by us for the purpose of processing and responding to your inquiries, and to improve our site and offerings.

C) If we provide a function for users to receive e-mail updates, and you sign up to receive such e-mail updates, we will collect and use your e-mail address for such purposes.

D) We will also collect personally identifiable information you voluntarily provide to us—typically, your name, postal address, e-mail address, and telephone number —when you participate in any other activities on our site, such as any polls, informational and promotional offers, or in connection with any additional products or services we may offer on our site.

E) If we offer presentations on or through our site, we may collect personally identifiable information from you when you register for such presentations.

F) We may associate or aggregate other information we obtain from third parties with personally identifiable information we have collected from you. We will treat any such information in the same manner as the information we have collected directly from you.

We may also collect information from you at other points on our site that state that such information is being collected.  It is completely optional for you to engage in activities for which you may provide, or be asked to provide, personally identifiable information.  Depending upon the activity, some of the information you may be asked to provide is identified as mandatory and some as voluntary.  If you do not provide the mandatory information with respect to a particular activity, you will not be able to engage in that activity.

We will primarily use your personally identifiable information to provide our Content and other products and services to you, and to process and respond to inquiries from you.  We may use personally identifiable information to deliver information to you and to contact you and send you information and/or marketing and promotional materials, including through postal mail, e-mail, and other means.  We may also use personally identifiable information to improve our marketing and promotional efforts, enhance operation of the site, fill orders, analyze website use, improve our content and product offerings, and customize the content, layout, and services of our site.  We may also use personally identifiable information to resolve disputes, troubleshoot problems and enforce the Terms & Conditions of Site Use and this Private Policy.

We also collect non-personally identifiable information from you as follows:

In general, we automatically gather certain information from our site visitors.  This information may include the Uniform Resource Locator (“URL”) of the webpages you visit, your browser and operating system, your Internet Protocol (“IP”) address, the name of your unique Internet service provider, the date and time of your site visits, how long you spend on our site, the number and frequency of your visits, what pages and content you view here and other similar information.  A URL is the global address of documents and other resources on the World Wide Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination. In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web, allowing Web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate on the Internet.  We may store this information in Web server logs or other similar technologies and as further described below.

We may employ services that use cookies, tracking code and other technologies to analyze how you use our site. The information collected (including but not limited to your browser and operating system, IP address and location, pages visited on our site and time spent here) is transmitted to and stored by others. We use this information to evaluate visitors’ use of this site in an aggregate manner, reports on website activity and other related services. This information may be transmitted to third parties that process information or as required by law.

By using this site with your browser setting adjusted to accept cookies, you consent to the use of cookies and other tools, by us, our website host, InMotionHosting.com, and any other third party servicer we have engaged, to provide the Content, products and services available on this site.

We and our authorized designees collect information through the servers for this site, cookies and other technologies. “Cookies” are small files placed on your hard drive that can later be retrieved to identify you to us; each website can send its own cookie to your browser if your browser preferences allow it.  Our cookies may store randomly assigned user identification numbers, the country where you are located and other information.  You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set.  Each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences. You are always free to decline our cookies if your browser permits, although that may prevent you from using certain features and functionalities on our site. In addition, a number of companies offer utilities designed to help you visit websites anonymously. We may use a “persistent” cookie to save information about your operating system and technology preferences and track website usage.   We may also use a “session cookie” to help us “remember” you until the session times out or the closing of your browser.  Usually the information collected through cookies and other technologies is not personally identifiable in and of itself. However, these technological methods may enable us to collect and use information in a personally identifiable form, and we may combine or aggregate data collected through cookies and other technologies with personally identifiable information; and in that case, we will treat the resulting information as personal information.

We may use an outside ad serving company to deliver some of the advertisements that are placed on our site. These advertising networks may use cookies, web beacons, or other technological methods to collect information about your visits to our site in order to provide you with relevant advertisements.  We will not provide any third-party ad server with any of your personally identifiable information.  We and our third party ad server will collect and use non-personally identifiable information about you, such as your IP address, browser type, the server your computer or mobile device is logged onto, the area code and zip code associated with your server and whether you responded to a particular ad.  Other advertisers may also place banner ads on our site in the same manner as above, but we will not disclose any personally identifiable information to them.

We are not responsible for any other websites accessible from or linked to our site, including such website’s privacy policies or information collection practices. Further, we do not control any cookies, web beacons or other similar devices placed on our site by third parties, such as those that may be embedded in third-party advertising.

We use this information to help us administer the site, analyze its usage, better understand how our viewers use this site, understand our viewer’ interests and behavior, protect the site and its content from inappropriate use, improve our viewer’s experience, provide customized services, content, information and advertising, and for other similar purposes.  We may also use cookies and other technologies to learn about and remember our visitors’ technology and other preferences, gain insight into and customize our visitors’ use of our site, and help maintain our site’s proper operation.

  1. Release of Information

We do not sell, trade, or rent your personally identifiable information to others.  We may share personally identifiable information with third party service providers we use in connection with the operation of this site to allow them to perform their function for us.  The use of your personally identifiable information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control.

If you decide to make a contribution to us using the contribution feature on our site, you will be asked to provide personally identifiable information (including your name, address, telephone number, and credit card number and information) to our third-party payment processing company, SquareUp. You are not obligated to make a contribution to use or access our site.  If you make a contribution, you acknowledge and agree that you and your rights related to disclosure of your personally identifiable information to SquareUp are governed by Square’s terms and privacy policies.  You further agree to release and hold harmless the Company and its owners, managers, officers, directors, employees, agents and representatives, from and against any and all liability, damage, loss, claims, expenses and fees (including attorneys’ fees) that result from, out of or in connection with your disclosure of personally identifiable information to SquareUp (including any unauthorized disclosure by SquareUp) in connection with a contribution to us.  If we are provided any personally identifiable information from you or SquareUp in connection with your contribution, our treatment of such information will be governed by this Privacy Policy.

Occasionally we may be required by law, requested by governmental entity or law enforcement authority, subpoena, court order or discovery request to provide your personally identifiable information, or when we otherwise believe in good faith that such disclosure is necessary or appropriate in connection with any activity that violates the law (including relating to intellectual property, fraud, contracts and privacy) or may expose us to liability.  We can, and you authorize us to, disclose any of your information in such circumstances.

We may also provide non-personally identifiable information about site visits, traffic patterns, and related site information to third party advertisers or others, but these statistics will not include any personally identifiable information.

  1. Security of Information

The security of your information is important to us. We take all commercially reasonable efforts to protect and secure your personally identifiable information. Your credit card transactions are handled by established third party banking and processing agents.  They receive the information needed to verify and authorize your credit card or other payment information and to process your order.

You should be aware, however, that “perfect security” does not exist on the Internet, and there is always the risk that unauthorized persons may access or use your personally identifiable information. As a result, while we strive to protect your personally identifiable information, you acknowledge that: (a) there are security and privacy limitations of the Internet that are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) it is possible that such information and data may be viewed or tampered with in transit by a third party.  You agree that you use our site and send us such information at your own risk.

You should also be aware that if you voluntarily disclose personally identifiable information (i.e. your name, email address, etc.) in discussion forums or other areas on the site that are accessible by multiple users, that information, along with any information disclosed in your communication, may be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information.  Any submissions to discussion forums or other areas accessible by multiple users on the site are made with the understanding that they are accessible to all third parties with such access. If you do not want your comments to be viewed by third parties with access to the site, you are advised not to make any submissions.

  1. User Choices on Collection and Use of Information

We may, from time to time, send to you by email or direct mail information about upcoming content, presentations, products or other services that may be of interest to you.  If you do not want to receive such information, please write to us at the address in Section 15 below, and we will remove you from our mailing list.

You also have choices with respect to cookies as described in Section 3 above.  By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our site may not work properly in your case.

  1. Updating and Correcting Information

We believe you should have the ability to access and edit any personally identifiable information you have provided to us.  You may access and correct your personal information and privacy preferences by writing to us at either the email address or mailing address listed in Section 15 below.  Please include your name, address, and/or email address when you contact us.   We encourage you to promptly update your personally identifiable information if it changes.

  1. Privacy Policies of Third Party Sites

Except as otherwise discussed in this Privacy Policy, this policy only addresses the use and disclosure of information we collect from you.  Other sites accessible through our site have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy.  We are not responsible for the policies or practices of third parties.  Additionally, other companies which place advertising on our site may collect information about you when you view or click on their advertising through the use of cookies. We cannot control this collection of information. You should contact these advertisers directly if you have any questions about their use of the information that they collect.

  1. Policy on Children

We are concerned about the safety and privacy of children who use the Internet. Our site is not designed for or directed to children under the age of 13. Consistent with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), we will never knowingly request personally identifiable information from anyone under 13 without prior verifiable parental consent. If we become aware that a child under 13 has somehow provided us with personally identifiable information without verifiable parental consent, we will use our best efforts to remove such information from our files. If you believe that your child has provided us with such information without your consent, please email or write to us at the address listed in Section 15 below.

  1. Merger or Transfer of Business

If we merge with or transfer substantially all of its business, stock or assets to another entity, or if we enter into bankruptcy, we have the right to share your personally identifiable information with that entity, to the extent lawfully permissible. If such merger or transfer results in a material change in the use of your personally identifiable information, you will receive notice of such event via an appropriate mechanism, as determined by us, and we will request that the new entity follow the practices disclosed in this policy or notify you of any changes to it.

  1. Changes to Privacy Policy

We may revise or supplement this Privacy Policy from time to time in our sole discretion. If we make any substantial changes in the way we use or share your personal information, we will notify you by posting an announcement on our site and sending you an email if you have provided us with your email address.
